Affiliation Terms

  1. AFFILIATION
    • IICT hereby grants to the AFFILIATE affiliation to the IICT Institute, empowering the AFFILIATE to conduct IICT Courses at its designated training centre in accordance with the syllabus and course requirements prescribed by IICT and the guidelines mentioned herein.
    • The infrastructure of the training centre shall be maintained by the AFFILIATE in accordance with the conditions prescribed by IICT from time to time.
    • The AFFILIATE shall bear all costs, consequences and expenses in relation to the set-up, operation and any other expenses involved in relation to the training centre and the conduct of the IICT Courses therein.
    • The AFFILIATE is free to charge any amount as training, coaching, teaching, tuition or other fees to any of its students and IICT shall in no way be responsible or associated with any such fees charged by the AFFILIATE.
    • The relationship between IICT and AFFILIATE shall in no way be construed as that of a Franchisor and Franchisee as contemplated under Section 65(47) of the Finance Act, 1994.
    • The affiliation granted herein shall not limit the rights of IICT to grant further affiliation to any other institute, company or person owning or operating any business within the same geographical area as the AFFILIATE.
  2. FEES AND PAYMENTS
    • The non-refundable affiliation fee for affiliation shall be payable with applicable taxes to IICT on or before the date of submission of this Application.
    • The payment of the affiliation fees mentioned above shall entitle the AFFILIATE to conduct the IICT Courses at its training centre for a prescribed period only. Before the expiry, the affiliation shall be renewed else the affiliation is terminated in accordance with the guidelines herein.
    • The AFFILIATE shall be liable to pay to IICT all charges towards books, course materials, stationery or any other materials, including all applicable taxes, purchased from IICT including any transportation, freight, packing and logistical expenses involved therein.
  3. IICT COURSES AND MATERIALS
    • IICT hereby authorises the AFFILIATE to conduct the IICT Courses including practical assignments at its training centre.
    • All books, course materials, stationary and any other materials used by the AFFILIATE to teach the IICT Courses including practical assignments, shall be purchased only from IICT after placing an order for the same with IICT by paying the charges involved therein including transportation, freight, packing and logistical charges.
    • The AFFILIATE shall conduct the IICT Courses including practical assignments in the prescribed manner in accordance with the course syllabus.
    • The AFFILIATE shall not use and shall not allow the use of any of the books, course materials, stationery or any other materials received from IICT for any purpose other than imparting training in the IICT Courses.
    • The AFFILIATE shall not use the name or logo of IICT or the IICT institution in any of its documents, receipts or any other materials. The AFFILIATE is only permitted to use the words “Affiliated to IICT” in banners, pamphlets and other promotional materials upon receiving approval from IICT.
    • The AFFILIATE shall ensure that each of its teaching personnel is qualified and competent to teach the IICT Courses.
    • All intellectual property in any of the books, course materials, stationery or any other materials shall be the exclusive property of IICT or the authors thereof, as the case may be and the AFFILIATE shall have no claims over the same.
    • All students enrolled for IICT Courses shall be provided receipts by the AFFILIATE for any fees or other amounts received.
  4. STUDENTS AND REPORTS
    • The AFFILIATE shall maintain a record of the students enrolled for all of the IICT Courses which shall include basic information about the student, type of course/s undergone by the student, all examination and other assessment reports, details of certificate issued and fees collected from the student and shall make the same available to IICT upon request or during any audit or investigation.
    • The AFFILIATE shall submit to IICT the list of students enrolled in the preceding calendar month on or before the 5th day of each calendar month in such manner as may be prescribed by IICT from time to time.
    • The AFFILIATE shall maintain an attendance record, keeping track of the number of classes attended by each student enrolled in the IICT Courses.
    • IICT is entitled to conduct audits or inspections of the training undertaken by the AFFILIATE at the Training Centre, examinations conducted, practical assignments rendered, and/or any other activities carried out by the AFFILIATE in relation to the IICT Courses, without any advance notice to the AFFILIATE and the AFFILIATE shall fully cooperate with any such audits or inspections.
  5. EXAMINATION AND CERTIFICATION
    • The AFFILIATE shall make suitable arrangements for the conduct of IICT Course examinations, including practical assignments at the training centre along with provision for online examinations, in accordance with the standards and instructions prescribed by IICT.
    • Where the AFFILIATE fails to make suitable arrangements for the conduct of examinations either online or offline, it shall be conducted in the place and manner prescribed by IICT.
    • The AFFILIATE shall conduct examinations for all students enrolled in IICT Courses in accordance with the IICT programme guide and course syllabus.
    • The AFFILIATE shall send all information regarding the conduct of examinations for the students at least 30 days prior to the intended date of commencement of examinations to IICT, in order to enable IICT to prepare and dispatch the requisite question papers.
    • The AFFILIATE is responsible for arranging for the valuation of the answer papers after the conduct of examinations.
    • Valuation must be conducted by the AFFILIATE in strict compliance with the IICT programme guide and other criteria prescribed by IICT.
    • All answer papers, after valuation by the AFFILIATE, must be sent to IICT, which will verify the correctness of the valuation in order to satisfy itself with the outcome of the examinations.
    • Subject to the complete satisfaction of IICT with regard to the valuation of the answer papers, attendance of the student and payment of the requisite examination fees by the AFFILIATE, IICT shall award certificates in the name of the students, as provided by the AFFILIATE, who have successfully passed the examinations.
    • The AFFILIATE shall alone be responsible for checking the correctness and genuineness of the information provided by the students and IICT shall not be held liable in any manner for the same.
  6. TERM AND TERMINATION
    • The AFFILIATE is hereby granted affiliation to the IICT institution by IICT for a period of 5 years from the date of submission of this application unless otherwise terminated by IICT for the reasons mentioned herein.
    • IICT may, at its discretion, terminate the affiliation of the AFFILIATE to the IICT institution by giving 7 days’ notice if it finds that the AFFILIATE
      • has not maintained an acceptable quality of training and teaching of the IICT Courses at the training centre, including the arrangement of requisite infrastructure;
      • has failed to maintain the genuineness of the examination process; or
      • has not enrolled any students for any of the IICT Courses for a continuous period of 3 months.
  7. GENERAL
    • The AFFILIATE shall strictly follow all the guidelines mentioned herein during the term of the affiliation.
    • The AFFILIATE hereby agrees to indemnify and keep indemnified IICT from and against any claims or actions arising out of or in any way relating to the conduct of the IICT Courses at the training centre, conduct of examinations, issuance of certificates to any of its students or any other of its activities that may cause loss or damage to IICT.
    • Any dispute that arises between IICT and the AFFILIATE in relation to the affiliation under these guidelines, which cannot be settled by mutual negotiations, shall be settled by arbitration at Mangalore under the provisions of the Arbitration and Conciliation Act, 1996 including any amendments made to the said Act from time to time.
    • The AFFILIATE agrees and undertakes to comply with all applicable laws, rules, regulations, tax regimes and other legal requirements and formalities whatsoever in relation to the conduct of the IICT Courses at the training centre.
